| What is the difference between freehold and leasehold lands titles in Malaysia? |
|
Leasehold - As defined in the National Land Code, they are leases of land granted for a maximum term of either 99 years if it relates to the whole of any alienated land or 30 years if it relates to only a part thereof. This is granted by the State Authorities. This means that the land is granted on a lease basis or alienated to a person or body on a fixed term basis. At the end of that period, the State Authorities can have the option not to continue the lease. In extension of such leases, the person or body being granted the lease can apply for renewal from the State Authorities by paying a premium on the extension.
Freehold - This means land in perpetuity, meaning there is no fixed term on the grant of the land to the person or body. The essentially means that the person or body owns the land in perpetuity, that is forever.
